Any access or use implies that the user has been informed of and accepts these terms.

4. Permitted use of the website
The user must use the website lawfully, in good faith, and in accordance with these terms. Indicatively, the following are prohibited:

- attempting unauthorized access to infrastructure, code, accounts, or data,
- the introduction of malicious software, bots, scripts, or techniques affecting availability or security,
- the automated collection of content without permission,

5. Accounts, dashboard, and credentials
If Exact3D provides an account, dashboard, or control panel, the client and its authorized users must keep access credentials confidential and immediately notify of any suspicion of unauthorized use. The client is responsible for actions carried out through its accounts, unless it proves that they are due exclusively to the fault of Exact3D.
6. Client content, data, and 3D assets
The client generally retains the rights to its own data, content, files, textures, CAD/3D models, materials, catalogs, technical specifications, and other assets provided for the implementation or operation of services. However, the client grants Exact3D the necessary right to use, host, reproduce, transform, technically process, and display them exclusively to the extent required for the provision of services, support, testing, backups, and technical maintenance.
7. Prohibited content
The use of the services for the storage, processing, or display of content that:
- is unlawful, defamatory, threatening, offensive, or infringes third-party rights,
includes malicious code or material that compromises security,- violates export regulations, trade restrictions, or intellectual property rights,
- is used in a misleading or fraudulent manner regarding the origin or capabilities of products.
8. Intellectual property of Exact3D
Subject to the rights of third parties and clients over their own content, the website, structure, software, code, know-how, trade dress, texts, graphics, logos, screenshots, interfaces, workflows, databases, renders, demos, and any other element belonging to Exact3D are protected under applicable intellectual and industrial property laws.
9. Limited license of use
Exact3D grants the user or client a limited, non-exclusive, non-transferable, and revocable license to use the website and, where applicable, its services, exclusively for the lawful business purposes for which they are provided. Exact3D makes reasonable efforts to ensure secure and smooth operation, but does not guarantee uninterrupted or error-free operation at all times. Updates, maintenance, technical interventions, fixes, or temporary interruptions may occur. Unless a specific SLA is agreed in a separate contract, availability is provided “as available.”
12. Integrations with third-party systems
Exact3D presents the capability to connect with WooCommerce, Shopify, ERP, CRM, and other systems through APIs or plugins. The proper functioning of such integrations often depends on third-party providers, client configuration, software versions, access rights, and technical prerequisites. Exact3D is not responsible for interruptions, API changes, limitations, errors, or policies of third-party systems affecting the integration, unless there is a different explicit contractual commitment.
13. Pricing, subscriptions, and payments
Where services are provided under a subscription or other financial model, the billing terms, setup fees, duration, renewal, termination, payment methods, tax charges, trial periods, credits, price adjustments, and any refunds are defined in the individual commercial offer, order, or agreement with the client.
14. Warranties and disclaimer
The website is provided for informational purposes and the services are provided in accordance with their agreed characteristics. To the maximum extent permitted by law, Exact3D excludes all implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such exclusion is not permitted.
15. Limitation of liability
To the maximum extent permitted by applicable law, Exact3D shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, loss of opportunity, loss of clientele, loss or alteration of data, or business interruption. The total liability of Exact3D arising from or in connection with the services shall not exceed, unless otherwise agreed in a contract, the amount paid by the client for the specific reference period prior to the event giving rise to the claim.
16. Indemnification
The client or user is obliged to indemnify Exact3D against third-party claims arising from unlawful content, infringement of third-party rights, unauthorized use, breach of these terms, or use of the services in a manner contrary to the law, to the extent that the claim results from an act or omission of the client/user.
17. Suspension and termination
Exact3D may suspend or temporarily restrict access in the event of a breach of terms, security risk, unlawful activity, non-payment, or the need for technical protection of the infrastructure.
18. Confidentiality
Within the framework of B2B collaborations, confidential information, technical data, commercial strategies, product files, and other non-public content may be exchanged. Unless a separate non-disclosure agreement (NDA) exists, each party is required to use such information exclusively for the intended collaboration and to take reasonable measures to protect it.
19. Personal data
The processing of personal data is governed by the Privacy Policy. Where Exact3D processes personal data on behalf of a client within the framework of SaaS services, a separate DPA may be required with more specific terms regarding security, subprocessors, return/deletion of data, and compliance audits.
20. Governing law and jurisdiction
These terms are governed by Greek Law. Any dispute arising from or in connection with the use of the website or services shall, unless otherwise mandatorily provided, fall under the exclusive jurisdiction of the courts of Athens.
21. Amendment of terms
Exact3D reserves the right to amend these Terms of Use for legal, commercial, technical, or operational reasons. The updated version is posted on the website indicating the date of last update and becomes effective upon publication.
